Hato Pintado: recent tower, are ducts covered by the builder warranty?

Moving into a new apartment in Hato Pintado and finding grey dust on the grilles in the first week is more common than it seems. What decides whether the developer pays is the paper signed at handover.

Short answer

It can, but not automatically. Law 45 requires the provider of a new construction to set the warranty terms in writing, and that document says whether ducts and air conditioning are covered and for how long. Construction dust is claimed as incomplete finishing, with dated camera photos taken before using the system, before the developer and, if there is no answer, before ACODECO.

Construction dust in brand new ducts

Hato Pintado was designed from the start as a high density residential area and, according to La Prensa, the lots at each corner of the forest park have zoning that allows apartment towers. That explains the recent cranes among the 1970s houses. A new tower delivers apartments whose ducts were installed months before painting, sanding and tile cutting happened on the same floor.

The EPA guide Building Air Quality, in its section on work in occupied buildings, calls for blocking return registers while work is under way so dust does not enter the system. On a construction site that is rarely done, and the result is a brand new duct with gypsum and cement dust settled on the bottom. It cannot be seen from the grille, but it comes out during the first week of use as a grey film over furniture and frames.

How to document it with a camera

The value of the evidence depends on timing. A dusty duct photographed before the system is switched on for the first time makes clear that the dust came from construction. The same duct photographed three months later, with the family living there and a kitchen remodel on the floor above, is open to debate. That is why it makes sense to request a camera inspection of the apartment before the first start up and keep the dated images.

Climatiza is the technical service behind this guide and works with camera inspection, an illustrated report and cleaning only when the condition justifies it, including in the case of Hato Pintado.

  • Date and time on every image, and the apartment number in the first frame.
  • One pass along each branch from the diffuser to the handler, not just the grille mouth.
  • Photo of the new filter as delivered by the developer, with its label.
  • Photo of the condensate pan and drain before any water runs through.
  • A sample of the dust on white paper beside the grille, to tell gypsum from household dust.
  • The unit hour meter reading, if it has one, to show it was not used.

What to ask the developer

The first thing is the warranty document for the work, which Law 45 requires to be delivered in writing with clear terms. According to the analysis published by La Estrella de Panamá, warranty clauses in purchase agreements usually recognize one year or less, so the clock runs from handover. With that paper in hand something concrete is requested: interior cleaning of the apartment ducts, a filter change and a second camera pass showing it was left clean.

It helps to separate construction dust from what cannot be claimed. The ten year liability under the Civil Code, which the same analysis describes, covers defects that compromise the structure, and a dirty duct does not fall there. The claim rests on the written warranty and on incomplete delivery, which is why photographic evidence weighs more than any technical argument.

Warranty terms and handover records

The handover record is the other document that defines the case. If the buyer signed that the apartment was received in good order, duct dust becomes hard to claim, because it cannot be seen from outside and nobody noted it. The practical way out is to write a reservation on the air system in the record pending camera inspection, or to attach the images if they were already taken.

Situation at handoverWhat makes sense
Record not yet signedRequest a camera pass before signing and note a reservation on ducts
Record signed, system unusedDated camera pass and written claim within the warranty term
Record signed, system in use for weeksDocument the dust type (gypsum) and request a joint check with the developer
Developer does not answerComplaint before ACODECO with record, warranty and images

Report for the owners board

In a Hato Pintado tower the problem is rarely confined to one apartment. If one has construction dust, the others on the same floor do too, and the ducts of common areas, lobby and corridors are usually worse because they were finished last. Law 284 of 2022 assigns the administrator the upkeep of common property with the budget approved by the assembly, so the collective claim is carried by the board.

A useful report for the board groups the images by floor, marks which branches are private and which common, and sums up on one page what is asked of the developer. The notes for condominium properties explain that border between private and common, and the guide to common areas in residential buildings details which runs usually fall outside individual warranties. The page on the service in Hato Pintado towers and houses shows how a visit for several apartments is scheduled on the same day, and the inspection planner helps set the second camera pass within the warranty term.

Frequently asked questions

In practice it is claimed as incomplete finishing, not as a structural defect. The ten year liability under the Civil Code covers damage that compromises the structure, and a dirty duct does not. What applies is the written warranty of the work and what was noted in the handover record.

It does not void it, but it weakens it. With the system in use, the developer can attribute the dust to the move or to neighbors remodeling. If it was already switched on, the dust type should be documented as soon as possible, since construction gypsum differs from household dust, and a joint check requested.

Usually the developer carries it out with its own contractor or agrees to reimburse the one the owner hires, as the warranty states. In either case camera images after the cleaning should be required, to close the claim with evidence rather than a signature.
